 Mary Ann Laun asked me to post the following that I wrote in response to a query to the CJC-L list:

The law and the Chancellor's office opinion is very clear and we have been following it since its release in Aug 2002. It's available at:
and scroll down the page to find M 02-22. CC Librarians in other states may find it useful, since it cites and is based on Federal law. You may already be familiar with it. Basically, it provides for the following options:
1) Only purchase captioned materials (we have chosen this option)
2) Obtain permission to caption (which we did with our current holdings, after extensive weeding)
3) Request ILL of captioned materials as needed
4) Provide an alternate selection, but what this means is, "find another video that is captioned that will provide the same instructional benefit"
5) Caption the video without permission, which under copyright law you can do if you have exhausted every other option and are unable to locate the copyright holder
These are the only legal options available to a California Community College.  On our campus, the library worked with our Disabled Students Programs and Services to inform staff and faculty. I revised our Reserve Materials Policy and Collection Development Policy to conform to the Chancellor's Office guidelines. I have worked with department faculty to educate them about using personal videos in class, or videos that they rent from local video stores, or that they keep for use within the department. However, I focus on ensuring that the library is compliant. In addition to your DSPS, your High Tech Center people may be helpful. The statewide web site is at:
